Terms of Service

1. Acceptance and scope

These Terms of Service (“Terms”) apply to use of www.buildguy.co.za and TBG SEO Engine. The services are operated by The Construction Man t/a The Build Guy, Company Registration No. 2024/530496/07, Gauteng, South Africa (“The Build Guy”, “we”, “us” or “our”).

By using the website or authorising a connected account in TBG SEO Engine, you agree to these Terms and the Privacy Policy. If you do not agree, do not use the relevant service or grant access.

2. TBG SEO Engine

TBG SEO Engine is a proprietary, internal WordPress administration application used by authorised The Build Guy personnel to manage website SEO, check content, maintain selected metadata and submit approved content to connected business channels.

It is not offered as a public software subscription, public publishing account or general consumer service. Access to its protected functions is limited to authorised administrators and may be changed, suspended or withdrawn at any time.

3. Google and other connected accounts

You may connect an account only if you are authorised to manage that account, its business assets and its published content. You remain responsible for reviewing the permissions displayed by the external platform and for keeping administrator credentials secure.

Google authorisation is handled through Google OAuth. TBG SEO Engine does not request the Google Account password. The read-only Search Console connection may list verified properties and retrieve search performance, sitemap and URL Inspection data. The Business Profile connection may list managed accounts and locations, submit authorised Local Post content and receive publishing status or error responses.

You can revoke Google access through TBG SEO Engine or through the Google Account’s third-party connection settings. External platforms have their own terms, policies, rate limits, review processes and technical restrictions, which also apply.

4. Content and publishing responsibilities

The person approving publication is responsible for ensuring that content is accurate, lawful, appropriately licensed and not misleading. Content must not infringe copyright, trade marks, privacy, confidentiality or other rights.

A website article remains the original source unless expressly stated otherwise. External versions may be shortened, reformatted or delayed by platform requirements. A failed social or business-profile publishing job does not invalidate or automatically remove the original website publication.

5. Acceptable use

You must not use the website or application to gain unauthorised access; bypass security or consent controls; publish spam, deceptive or unlawful material; distribute malicious code; interfere with service availability; impersonate another person or business; scrape protected data; or use a connected account beyond the permission granted by its owner.

We may block an action, disconnect an account or suspend access where we reasonably believe that security, law, platform policy, data protection or The Build Guy’s reputation is at risk.

6. Website information, calculators and enquiries

Website articles, calculators, starting rates, maintenance-plan descriptions and planning tools provide general guidance. They are not a final quotation, professional engineering advice, municipal approval, statutory certification or a guarantee that work is suitable for a particular property.

An enquiry, questionnaire submission, email, telephone call or WhatsApp message is a request for contact or assessment only. A binding construction or maintenance agreement arises only from a written proposal or contract accepted by the relevant parties.

7. Availability and third-party services

We aim to keep the website and TBG SEO Engine secure and available but do not guarantee uninterrupted or error-free operation. Features may be updated, temporarily unavailable or discontinued for maintenance, security, legal, platform or business reasons.

We are not responsible for an outage, rejection, delay, content change, account restriction or data practice controlled by Google, Meta, LinkedIn, Reddit, Medium, a hosting provider or another third party. Links to third-party sites are provided for convenience and do not transfer control of those sites to us.

8. Intellectual property

The Build Guy name, logos, website design, original text, calculators, application code and TBG SEO Engine branding are owned by or licensed to The Build Guy and are protected by applicable intellectual-property law. No right is granted to copy, resell, reverse engineer, republish or create a competing derivative product except where mandatory law permits it or written permission is given.

You retain ownership of content you lawfully supply, but grant us the limited permission needed to store, format and publish it through the authorised service.

9. Disclaimers and limitation of liability

To the fullest extent permitted by law, the website and application are provided on an “as available” basis. We do not guarantee search ranking, traffic, leads, approval by a platform, continued API access, publication timing or commercial results.

We are not liable for indirect, incidental, special or consequential loss arising from use of or inability to use the website, application or a third-party platform. Nothing in these Terms excludes liability that cannot lawfully be excluded, or limits rights that apply under mandatory consumer-protection law.

10. Changes, governing law and contact

We may update these Terms when the website, application, connected services or legal requirements change. The current version and effective date will be published at this URL. Continued use after an update constitutes acceptance of the revised Terms where permitted by law.

These Terms are governed by the laws of the Republic of South Africa. Disputes are subject to the jurisdiction of the competent South African courts, without limiting any mandatory consumer right to approach another authorised forum.
